ACCEPTANCE OF TERMS
By clicking on the "Yes" button, you are consenting to
be bound by this agreement. If you do not agree to all of the terms
of this agreement, click the "No" button and the installation
process will not continue. You may then return the product to the
place of purchase for a full refund.
GRANTING OF LICENCE
Subject to payment of the applicable licence fees, Actinic Software
Limited (Actinic) grants to you a non-exclusive licence to use Actinic
Catalog (Catalog) in the manner described below.
Payment of the applicable licence fees also entitles you to e-mail
support and assistance provided you are using the current release
of Catalog or its immediate predecessor.
LICENCE TERMS
Actinic grants to you a non-exclusive licence to use Catalog in
the manner described below :
You may:
A. use Catalog on any single computer;
B. use Catalog on a second computer so long as only one copy is
used at a time;
or C. copy Catalog for archival purposes, provided any copy must
contain all of Catalog’s proprietary notices;
You may not:
A. permit other individuals to use Catalog except under the terms
listed above;
B. permit concurrent use of Catalog;
C. modify, translate, reverse engineer, decompile, disassemble (except
to the extent applicable laws specifically prohibit such restriction),
or create derivative works based on Catalog;
D. copy Catalog other than as specified above;
E. rent, lease, grant a security interest in, or otherwise transfer
rights to Catalog;
or F. remove any proprietary notices or labels on Catalog.
TITLE
Catalog is protected by copyright laws and international copyright
treaties, as well as other intellectual property laws and treaties.
Catalog is licensed and not sold.
This Licence may not be assigned, sublicensed or otherwise transferred
by the Licensee, by operation of law or otherwise, without prior
written consent from Actinic.
TRADEMARKS
Actinic Catalog is a registered trademark of Actinic Software Ltd.
TERMINATION
Without prejudice to any other rights, Actinic may terminate this
agreement if you fail to comply with the terms and conditions of
this agreement. In such event, you must destroy all copies of Catalog.
DISCLAIMER OF WARRANTY
Catalog and the accompanying files are sold "as is" and
without warranties as to performance of merchantability or any other
warranties whether expressed or implied. Because of the various
hardware and software environments into which Catalog may be put,
no warranty of fitness for a particular purpose is offered.
Good data processing procedure dictates that any program be thoroughly
tested with non-critical data before relying on it. The user must
assume the entire risk of using the program. Any liability of the
seller will be limited exclusively to product replacement or refund
of purchase price.
LIMITATION OF LIABILITY
Under no circumstances and under no legal theory, tort, contract,
or otherwise, shall Actinic or its suppliers or resellers be liable
to you or any other person for any indirect, special, incidental,
or consequential damages of any character including, without limitation,
damages for loss of goodwill, work stoppage, computer failure or
malfunction, or any and all other commercial damages or losses.
In no event will Actinic be liable for any damages in excess of
the amount Actinic received from you for a licence for Catalog,
even if Actinic shall have been informed of the possibility of such
damages, or for any claim by any other party. This limitation of
liability shall not apply to liability for death or personal injury
to the extent applicable law prohibits such limitation. Furthermore,
some jurisdictions do not allow the exclusion or limitation of incidental
or consequential damages, so this limitation and exclusion may not
apply to you.
REGISTRATION
Actinic Catalog will be automatically registered at an Actinic web
site the first time that it is used on the web. This is a measure
to prevent software piracy. The registration details will not be
passed to any third party.
EVALUATION
In the event that your use of Catalog is for the purpose of evaluating
whether to purchase a licence for Catalog, Actinic grants you a
non-exclusive licence to use Catalog free of charge. The evaluation
period for use is limited to 30 days and all of the Licence Terms
above apply (except Granting of Licence). During that period you
are entitled to e-mail installation support.
